Mumbai: 32-yr-old man gets 10 years in jail for raping 14-year old girl
A complaint was filed by the parents of the girl, who said that in March 2019, their daughter left their home on some pretext but did not return.

A special court on Monday sentenced a 32-year-old man to ten years imprisonment for raping a 14-year-old girl. The court held that even if one were to consider the defence of the accused that the victim and he were in a love affair, since the girl is a minor, she is unable to give her consent for sex.
A complaint was filed by the parents of the girl, who said that in March 2019, their daughter left their home on some pretext but did not return.
An FIR on sections of kidnapping were filed since the girl was a minor. She and the accused were later found in Uttar Pradesh. The girl in her statement had said that she was roaming around her house when the accused approached her and pressured her into going to a relative’s home, where she was made to stay for a week and repeatedly sexually assaulted. The accused said that the two were in a relationship and that the victim’s mother was aware about it.
“From the cross-examination of the victim and her mother for the sake of moment though, it can be said that it was love affair between the victim and accused, victim had voluntarily joined the company of accused but she is minor and unable to consent for sexual intercourse and therefore, there is no question to consider the defence that victim voluntarily joined the company of accused,” the court said.
