(Express File Photo)The Motor Accident Claims Tribunal (MACT) in a recent order directed a payment of nearly Rs 5.50 lakh in compensation to a 26-year-old man who lost three toes while boarding a BEST bus.
On August 19, 2019, the applicant, Manoj Dhuria, was traveling on a BEST bus. While he was still boarding the bus, the conductor rang the bell to signal the bus to move. Since the driver started the bus at high speed, Dhuria’s foot got stuck under the bus, due to which he lost three toes of his foot.
“There is an amputation of the second, third and fourth toes. Therefore, there is absolutely difficulty in walking and climbing stairs,” the tribunal said.
It said it would consider a notional income for the applicant to decide on the compensation. It directed payment of Rs 1,00,000 towards pain and suffering due to amputation of toes.
“He is entitled for Rs 30,000 towards loss of amenities, and Rs 2,50,000 towards future loss of income. He is also entitled for Rs 10,000 each for special diet and conveyance. Thus the applicant is entitled for a total compensation of Rs 4,30,000 from the opposite party,” the tribunal said.
