A special court rejected the bail application of an accused arrested in the ISIS module case, rejecting his defence that he was of unsound mind and suffers from psychological illness.
The accused was arrested by the National Investigation Agency in 2023. In his bail plea, he had claimed that he was undergoing treatment for schizophrenia and obsessive compulsive disorder since 2020, citing a medical certificate from a hospital. He also claimed that there is no evidence to show his involvement in the alleged offence. The NIA opposed his plea stating that the offences date back to 2016 and before his arrest, the accused has been using social media, electronic gadgets, technical equipment and was involved in ideology debates and discourses.
The court noted that there are allegations that the accused had pledged allegiance to the Khalifa of terrorist organisation, ISIS, and had also prepared content for its magazine, and also claimed that he was in touch with various ‘foreign handlers’.
“If all this material has any indication, no person of sound mind would dare to call present applicant/accused to be a person of unsound mind. At least when he indulged in all the above acts which certainly posed great threat to the unity, integrity, security and sovereignty of the country. He was determined and firm,” special judge Chakor S Baviskar said in the order on September 4, made available on Wednesday.
“Thus, ground of insanity in my opinion is prima-facie a false ground. Hence, the applicant/accused cannot take benefit of this prima-facie false ground of insanity,” the court said.
