2 days after high court order, first FIR lodged for feeding pigeons in Mumbai

The FIR was lodged by the Mahim police after some people fed pigeons at a kabootarkhana near L J Road.

The Mumbai police on Friday registered a First Information Report (FIR) against unknown persons for feeding pigeons at a kabootarkhana (feeding areas for pigeons) near L J Road in Mahim, two days after a Bombay High Court directive on the matter.

A senior police officer said that around 6.50 am on Friday, some people came on a bike to the kabootarkhana and fed pigeons. “Since this was in violation of the recent Bombay High Court order, an FIR has been registered against them,” the officer said.

The police said they will track down the accused with the registration number of the bike they used.

The offence has been registered under sections 223 (disobedience to order promulgated by public servant), 270 (public nuisance) and 271 (negligent act likely to spread infection of dangerous disease) of the Bharatiya Nyaya Sanhita.

Earlier on Wednesday, the Bombay High Court directed the Brihanmumbai Municipal Corporation to lodge FIRs against persons “illegally” and in “defiant” manner feeding pigeons at Dadar (West) and other kabootarkhanas despite a policy prohibiting the same and the high court refusing interim relief for feeding in its earlier orders.

The court remarked that if they “don’t want to follow the rule of law, then the law should catch up with them.”

The court referred to a news report and photographs of the Dadar Kabootarkhana area produced before it, and observed that the photographs were quite telling and the matter was of immediate concern.

“Despite clear directives which are sought to be implemented very rigorously, and court refusing to grant any stay on such directives of the BMC, it appears to be rampant that the feeding of pigeons at these prohibited places has continued unabated,” the high court observed.
