Elgaar Parishad case: Shoma Sen walks out of jail after six years

Former Nagpur University professor Shoma Sen was released on Wednesday after being granted bail by the Supreme Court in the Elgaar Parishad case on April 5. Sen walked out of Byculla women’s prison, nearly six years after she was arrested by the Pune police.

Sen’s family, including her daughter and friends, were at the prison to receive her. Sen was arrested on June 6, 2018. Sen was among the 16 persons arrested by Pune police and the National Investigation Agency (NIA) in the case.

A bench of Justices Aniruddha Bose and Augustine George Masih had said in the order granting Sen bail that “if we examine the acts attributed to the appellant by the various witnesses or as inferred from the evidence relied on by the prosecution, we do not find prima facie commission or attempt to commit any terrorist act by the appellant…” in terms of the Unlawful Activities (Prevention) Act.

Over the past week, Sen’s lawyers were completing the bail formalities which were completed on Tuesday, paving way for her release.

Among the conditions set by the trial court for her release are that she cannot leave Maharashtra and needs to inform the investigation officer of the NIA about her place of residence. The court has also said that while on bail, she shall keep the GPS location status of her phone active 24 hours a day and that her phone shall be paired with the investigating officer.

Sixteen arrests were made in the case — nine by the Pune police in 2018 and seven by the National Investigation Agency (NIA) in 2020 after it took over the probe.

Sen’s daughter, Koel, a filmmaker, posted photos with her after her release on social media. “We have all waited for this moment for far too long,” her post said.
