Elgaar Parishad case: HC grants temporary bail to accused Sagar Gorkhe to attend brother’s wedding

The Bombay High Court recently granted temporary bail from May 1 to 4 to Elgaar Parishad accused Sagar Gorkhe for attending his brother’s wedding.

A division bench of Justices Ajey S Gadkari and Shyam C Chandak on April 24 passed an order in appeal by Gorkhe argued through senior advocate Mihir Desai, challenging rejection of temporary bail plea by the special court designated under National Investigation Agency (NIA) Act.

Advocate Sandesh Patil for NIA opposed Gorkhe’s plea stating that his request for temporary bail for 20 days between April 19 to May 9 was unacceptable. He submitted there are many other relatives who would attend the marriage ceremony, therefore the presence of the appellant is not necessary. Patil however submitted that necessary orders in the interest of justice may be passed by the bench.

The bench noted that a special court had on April 28, last year allowed Gorkhe to appear for state Law entrance examination and there was no record that he misused the said liberty and he was taken back to Taloja central jail within stipulated period of time.

Accepting Gorkhe’s plea, the bench granted him temporary bail from 9 am of May 1 till 6 pm of May 4 (both days inclusive) on execution of personal bond of Rs. 25, 000. It asked the Navi Mumbai Police commissioner to provide necessary escort in civil dress and shall be given waiver of escort charges by the state.

It also said that Gorkhe shall not misuse the permission granted to him and shall not indulge in tampering of evidence while on temporary bail.
