Elgaar case: Accused lawyer granted temporary bail to attend family wedding

A SPECIAL court on Thursday allowed lawyer Surendra Gadling, an accused in the Elgaar Parishad case, to be released on temporary bail from December 25 till January 2, 2024, to attend the wedding of his family member in Nagpur.

Gadling, who was arrested by the Pune police in 2018, submitted to the court that he should be allowed to travel to Nagpur for 15 days for the wedding on humanitarian grounds.

He said that in 2021, the Bombay High Court had granted him interim bail to attend rituals on his mother’s first death anniversary.

Gadling said that there were no reports of any violation of his bail conditions and hence he can be considered for temporary bail.

Gadling also told the court that he has been in custody for five-and-a-half years and the court should consider his plea.

Special Public Prosecutor Prakash Shetty representing the National Investigation Agency (NIA) opposed the plea but he said that considering the circumstances, Gadling can be permitted only for 2-3 days when the main rituals take place and not for a longer period.

Special Judge Rajesh Katariya directed Gadling’s release on temporary bail on conditions including that he shall submit to the NIA and the local police details of his travel, address of where he will be staying and directed him to mark his presence before the local police on three days.

He was also directed to not leave Nagpur while on temporary bail and that he shall surrender at Taloja jail on January 3.
