The Bombay High Court on Thursday directed the Wakf Board to decide afresh on a dispute between Sunni and Ahle Hadees sects over conducting the Urs at the Hazrat Shaikh Ahmed Shah Parus Dargah in Kalyan that has remained closed since 1988.
Madeena Shaikh had moved the court after claiming the Thane police had refused to grant police protection for holding the Urs at the dargah. Shaikh,in her petition,had stated that they are devout followers of Hazrat Shaikh Ahmed Shah Paru and that they cannot be deprived of their legitimate right to perform Urs at his Dargah only because Ahle Hadees sect does not believe in religious activities.
Her counsel Rizwan Merchant submitted that Kot-Bahar Masjid Trust has put a lock on the passage leading to the dargah despite having no rights over the140 square feet land where the dargah is located in Kalyan.
Abad Ponda,representing the Ahle Hadees sect,on the other hand complained of breach of principles of natural justice. He countered the petition saying an opportunity of hearing is bare minimum expectation under the principles of natural justice but the Wakf Board passed orders on Shaikhs application without even issuing notice to them.
The court has ordered the Wakf board to reconsider the application and give a fresh decision by June 15.
