Badlapur case: Senior police inspector suspended after departmental probe, Maharashtra govt tells Bombay HC

The state government on Tuesday informed the Bombay High Court that it has suspended Senior Police Inspector of Badlapur Police station, who was investigating sexual assault case, for deriliction of duty by delaying in lodging the FIR in the case.

The government said that departmental inquiry was conducted against the officer and two police constables of the police station were let off after giving them “strict warning” for not dealing with the case in the serious manner.

A bench of Justices Revati Mohite-Dere and Prithviraj K Chavan was hearing suo motu PIL initiated by it after taking cognisance of news reports over the sexual assault of two four-year-old children by a cleaning staff at a school in Badlapur of Thane in August.

The probe was transferred to the Special Investigation Team (SIT) of the state police.

Public Prosecutor Hiten Venegaonkar told the bench that two chargesheets were filed in the case and besides suspension of the police officer, her two year-increment was also withheld.

Moreover, Venegaonkar said that the report of the committee formed based on the court’s directives to recommend safety measures in school will be submitted next month.

The HC accepted the statement and posted a hearing on the issue of whether the parents of the accused cleaning staff killed in police encounter can be granted police protection on Thursday, December 19.

While the state lawyer said the deceased’s parents have refused police protection, their lawyer denied the same.

After the state lawyer submitted that the two four-year-old children were shifted to another school but the school leaving certificate and refund of school fees were not issued yet, the HC asked Venegaonkar to look into the matter.
