A sessions court on Wednesday acquitted a 67-year-old man and his two sons accused of assaulting a family. The trio was acquitted of all charges against them after the complainant failed to identify the accused in the court.
According to the prosecution,Mohammad Siddiqui along with his sons Mohammad Javed and Mohammad Shanawaz had assaulted Shahnawaz Mansoori who accidentally rammed his Skoda car into Siddiquis taxi. The case dates back to June,2006.
Siddiqui was repairing his taxi outside his house near JJ flyover when the incident occurred. Enraged at this,Siddiqi along with his sons allegedly attacked Mansoori and family with an iron rod. Mansoori suffered severe injuries. The trio was arrested immediately after the incident and spent three years in jail before getting bail last year. Police booked them under various sections of the Indian Penal Code (IPC) for attempt to murder and causing grievous hurt.
However,when the case reached the trial stage,the complainant failed to identify Javed and Shahnawaz in the court.
Defence lawyer Abdul Vahab Khan contented that the police had failed to carry out routine identification parade. During their depoisition,no witness talked about the usage of iron rod. Prosecution too could not show the seizure of rod in the court, said Khan.
Sessions Judge V B Khamkedkar acquitted all three of all the charges.
