A day after the Supreme Court upheld its order quashing land acquisition in Greater Noida,the Allahabad High Court today stayed land acquisition by the Uttar Pradesh State Industrial Corporation (UPSIDC) in a village in Bulandshahr using the same urgency clause.
Since the land was acquired in 2004,it has been lying idle,without the farmers even getting compensation.
A Division Bench comprising Justices Ashok Bhushan and Ranvijay Singh stayed the acquisition process pertaining to land in Luhakar village of Bulandshahr district questioning the need for invoking the urgency clause when no work has been started on the 25 hectares. The court has asked for state and UPSIDC affidavits in within four weeks.
The petitioners said the UPSIDC had put a notice for acquisition of land in Luhakar in 2002 under Section 4 of the Land Acquisition Act (for acquisition of land for public purposes).
However,the UPSIDC… also invoked the urgency clause foregoing the rights of tenure-holders to be heard before land is acquired, the petitioners said. Till now,the petitioners added,the UPSIDC has not taken the land under its possession.
