Rai Bareli resident challenges Sonia’s election as MP

A petition challenging UPA Chairperson Sonia Gandhi’s election as an MP from Rai Bareli was filed at the Lucknow Bench of Allahabad High Court on Thursday.

A petition challenging UPA Chairperson Sonia Gandhi’s election as an MP from Rai Bareli was filed at the Lucknow Bench of Allahabad High Court on Thursday.

Rakesh Singh, the petitioner and a resident of Rai Bareli, has raised objections to Gandhi’s citizenship.

“Gandhi has obtained citizenship by registration under rule 14 of the Rules of Citizenship. Citizenship through registration provides the Right to Domicile which may include ration card, passport and right to residence in India,” said Ashok Pandey,Singh’s counsel.

To become a MP,however, naturalisation of citizenship of foreign country under rule 15 (1) is a must,he added.

“Naturalisation is a separate and distinct procedure requiring a kind of no objection certificate from the native country,” claimed Pandey.

The UPA chairperson hasn’t completed citizenship formalities and hence, faces the risk of losing her parliament membership,he argued. Justice Alok Kumar Singh will hear the case on September 4.
