Former BSP minister Nand Gopal Gupta Nandi,Naini Central Jail Superintendent Ambrish Gaur and the Deputy Superintendent have been named in an FIR registered on Friday in connection with a clash between Dilip Mishra and other inmates inside the Naini jail on Thursday.
Dilip is an accused in the bomb attack on Nandi, which had occurred on July 12,2010,in which The Indian Express reporter Vijay Pratap Singh and another person were killed.
The FIR has been registered on a complaint lodged by Archana Mishra, wife of Dilip, and a pradhan of Lavayan Kalan village in Naini area. Dilips wife has alleged that Nandi,in collusion with the jail administration, had conspired to kill her husband. She has also claimed that Nandi paid Rs 1 crore to the jail administration for the purpose, said Inspector In-charge (Naini),R D Yadav.
The case has been registered under sections 323 (voluntarily causing hurt),506 (criminal intimidation) and 120-B (criminal conspiracy) of the Indian Penal Code, naming Nandi and the jail officials.
Nandi, who has been claiming his name was being unnecessarily dragged in criminal cases by those accused in the bomb attack case, said it was yet another instance of the same. He has said he would not withdraw his complaint against them.
Two other FIRs have also been registered in connection with the same incident. One has been lodged by Pramod Singh and Awadhesh, the two inmates who sustained injuries during the clash. They have accused Dilip of starting the fight without any provocation. The deputy jailer has lodged another FIR on the clash that took place among some inmates, including Dilip,Pramod,Awadhesh and Rizwan alias Motu Mali.
However, the police said initial investigation into the incident indicated that it was a fight between the inmates over maintaining supremacy. There is no evidence to suggest it was a criminal conspiracy on the part of either the administration or the former minister. The injuries sustained by Mishra are hardly one cm deep. That is why,Section 307 of the IPC has not been invoked, said Circle Officer (Karchhana),Radhey Shyam, who is investigating the incident.
On June 12,Nandi and his cousin Kamal Kumars name was dragged in the murder of Anita, wife of Rajesh Yadav, who is also an accused in the bomb attack case and is lodged in the Naini Jail. Anita was murdered by unidentified persons. The police have filed a final report in the FIR naming Nandi and his relative. It was lodged on the complaint of Anitas daughter Khushboo.
