Facing inquiry, UP cop submits ‘forged’ acquittal order to clear name in 2005 case — now faces fresh FIR

Booked in a 20-year old case, a police constable in Uttar Pradesh, presently posted in Fatehpur, decided to clear his name during an inquiry — by allegedly submitting a forged court order showing his “acquittal”.

The forgery came to light when the ‘court order’ was checked. According to police, constable Bhai Lal allegedly used the fabricated order to tilt the inquiry in his favour at a time when his promotion was pending.

Banda police have registered a fresh case against Lal, who is in his 40s.

The case from 2005, when the policeman was posted in Banda, pertains to voluntarily causing hurt and criminal intimidation. Bhai Lal had been suspended briefly before being reinstated, said police.

Circle Officer, Banda, Krishna Kant Tripathi said that during a detailed inquiry, the court order submitted by Bhai Lal was found to be fake. Following the confirmation of the forgery, a case was registered against the constable at the Naraini police station.

The case has been filed under IPC sections 467 (forgery), 468 (forgery for purpose of cheating), 420 (cheating), 471 (using as genuine a forged document) and 419 (cheating by personation).

No arrest has been made yet.

According to police, while the departmental inquiry against Bhai Lal was underway, the inquiry officer sought an updated report from the Naraini police station regarding the 2005 case pending against him. A search of records was conducted at the police station, after which a report was prepared and forwarded to the inquiry officer.

The report stated that as per official records, the case had been investigated and a chargesheet was filed in court. It further clarified that the matter is still pending in court.

The report stated that in the 2005 case, the chargesheet was filed under IPC sections 323 (punishment for voluntarily causing hurt), 325 (punishment for voluntarily causing grievous hurt) and 506 (criminal intimidation). Charges are yet to be framed against Bhai Lal.

The Circle Officer added that the inquiry officer reported that Bhai Lal had submitted a court order, claiming he had been acquitted in the case in 2016. The document was subsequently sent for verification.

During the probe, it was found that the purported court order was fake and that the case is still pending before the court. Following this confirmation, it was decided that an FIR should be lodged against him.
