Woman or wife cant be forced to cohabit
The Allahabad High Court on Thursday observed that no person can force a woman or his wife to cohabit and establish conjugal rights,if the woman or the wife refuses to do so. In such cases,woman or the wife cannot be forced by a decree in suit to establish conjugal rights, observed Justice Rakesh Tiwari.
The observation was made during the hearing of an appeal filed by one Rizwan Ali Khan seeking a decree for restitution for conjugal rights. Justice Tewari later dismissed the appeal. The court was of the view that the respondent,Nazma Siddiqui,has denied her marriage with the appellant. Even if it was presumed that she was married to Khan,the marriage has not been consummated and so no decree that will direct wife to establish conjugal relations with her husband can be given,the court said.
Officiating principals can continue during extended period
The full bench of Allahabad High Court on Thursday ruled that officiating principals of intermediate colleges under Uttar Pradesh Board in the state will continue to hold their posts till the extended period of their service.
The Bench comprising Acting Chief Justice Amitav Lala,Justice Ashok Bhushan and Justice Arun Tandon held that the officiating principals could continue as principals and not as lecturers during the extended period.
