Allahabad HC stays service termination of ad-hoc employees

The Allahabad High Court has stayed the orders of the Registrar General of the Allahabad High Court tthat called for the termination of services of Class III and IV employees working on ad-hoc basis in various district courts of Uttar Pradesh.

In what comes as a reprieve to over 1,000 employees,the court on Friday ruled that the appointment of these employees on ad-hoc basis will continue till the disposal of the special appeal and that their salary shall be paid by the respondents — High Court Of Judicature,Allahabad.

The Division Bench comprising Justices Vijay Manohar Sahai and Virendra Kumar Dixit has also asked the Registrar General to explain why these persons were engaged on ad-hoc basis when regular vacancies were available and why no appointments were made on the vacant posts.

Hearing the special appeal filed by the affected employees against the order of the single Judge,whereby their demand of relief against termination of service order was declined,the court has sought information on the number of employees working on ad-hoc basis or in tenure appointments in the District Courts of the entire state and also asked for how long they have been working.

Directing the high court registry to explain as to whether UP Regularisation on ad-hoc appointment Rules,2001,had been adopted by the high court or not,the Court observed that the termination orders,dated November 5,2009,prima facie appears to be arbitrary and was passed in violation of the principles of natural justice.

The High Court will hear the case on February 23.
