The Lucknow Bench of the Allahabad High Court on Tuesday gave four weeks time to the state government to submit the minutest of details concerning the status of compensation given to victims of 1984 anti-Sikh riots in Uttar Pradesh.
The court was hearing a petition,filed by one Amir Singh Virk,a riot victim,who alleged that meagre compensation was being given to the families of those who died in the riots.
The Bench comprising Justices D P Singh and S C Chaurasia asked Home Secretary Anand Kumar,who appeared in person,to submit details of the inquiry reports,damages done in Uttar Pradesh,total number of victims,numbers of those who have been compensated,amount of compensation,formula used to calculate the compensation,and details of people involved in deciding the compensations.
The court also sought information on all those who were involved in the spot inspections of the sites where riots took place and whether they were the right persons to decide on the amount of compensation.
In his affidavit,the Home Secretary stated that 6,747 people were identified for receiving compensation while 2,354 people had been given the compensation.
Government counsel Adarsh Mehrortra told the court that compensations were being decided on the basis of the Justice N K Mukherjee Commission Report and Justice Nanawati Commission Report. He said that committees comprising the DM and ADMs were constituted by the government to decide on the compensation.
The court observed that the compensation amount given to victims was meagre and asked the government why it could not take the help of experts,like surveyors,to decide on the damages, said Umesh Verma,who has been appointed as amicus curiae in the case. The court also asked ther aggrieved persons to submit details related to the case to the advocates of both sides,added Verma.
