Responding to Calcutta High Court order passed Thursday, retired IPS officer Nazirul Islam Friday filed an affidavit stating he would not get justice from a division bench headed by Justice Ashim Kumar Banerjee.
Moving the affidavit, advocate Surajit Samanta asked the division bench headed by Justice Banerjee to release the case as Islam had no faith on the bench.
The affidavit pointed out that the bench on February last week had cancelled a CAT order in connection with the appointment of five DGP of the West Bengal Police.
Based on a petition filed by Islam, CAT had cancelled the appointment of the five DGPs, however, the division bench headed by Justice Banerjee had set aside the order after its was challenged by the state government in HC.
Terming the earlier court verdict biased, Samanta told the bench headed by Justice Banerjee: “We know the story of the Judgment-Seat of Vikramaditya in history. There is a popular quote in legal world that justice should not only be done; it must be seen to be done. It is the feeling of Islam that he would not get justice from this Division Bench.”
However, refusing to release the case on the basis of the affidavit, the bench posted the matter for Wednesday.
