Settle mishap claims in four months: HC

The Delhi High Court on Monday directed the Delhi Police and insurance companies to implement the Claims Tribunal Agreed Procedure on trial basis.

The Delhi High Court on Monday directed the Delhi Police and insurance companies to implement the Claims Tribunal Agreed Procedure (CTAP) on trial basis. Under CTAP,road accident victims will get compensation within four months of the mishap.

“The procedure shall commence from January 15,2010 and tentatively remain in force for a period of six months,up to July 14,2010,” Justice J R Midha said.

The Centre told the court that it would consider giving funds to the Delhi Police for creating a special cell and making other arrangements to handle accident cases.

In an oral judgement,Justice Midha directed the Delhi Legal Services Authorities,the Delhi Police,the Ministry of Finance and all insurance companies to publicise the implementation of the project.

The court also asked the hospitals to prepare and handover the MLCs of accident cases within 15 days to the police so that the probe can be completed in a month.

The court also approved the suggestion that the police would provide accident information report within 30 days to the insurance company and the Motor Accident Claim Tribunal (MACT).

A committee,comprising officers from the Ministry of Road Transport and Highways,Finance,Law and Justice and Company Affairs and the Joint Commissioner of Police (Northern Range),will monitor the implementation of the project.

The court’s order came while hearing an accident claim petition in which the victim’s family has been struggling for several years to get compensation.
