A Delhi court has awarded a compensation of over Rs 1.53 crore to the family of a man, who died in an accident due to the “negligent and rash act” of a truck driver. The driver had parked his vehicle in the dark in the middle of a highway.
The Motor Accident Claims Tribunal (MACT) has awarded a compensation of over Rs 1.53 crore to the family of 39-year old Nikhil Mehta — a software professional based in Delhi who died in the accident in April 2011.
The tribunal has directed New India Assurance Company Ltd — with which the truck was insured — to pay Rs 1,53,04,188 compensation to the wife, two children and the mother of the deceased.
In the petition, Mehta’s family said the accident had taken place around 4 am on April 22, 2011, when they were going to Himachal Pradesh in a car, driven by the victim’s brother. Near a village in Punjab’s SAS Nagar district, an overloaded truck was wrongly parked in the middle of the road without any indicator or lights blinking. The car struck the right side of the truck.
Due to the impact, Mehta suffered grievous injuries and was taken to a hospital, where he was declared brought dead.
“From all the facts and circumstances, it is clear the accident was caused when it was dark and the truck was found standing on the highway, this act itself is rash and negligent, thus the petitioner has been able to prove that the accident was caused due to rash and negligence act of the driver,” MACT Presiding Officer Ajay Kumar Jain said.
