PMLA enquiry: ED seeks info on ATS Group from Noida Authority

The Enforcement Directorate (ED) has asked the Noida Authority to provide details of 63 companies associated with ATS Group — among the biggest real estate developers — pertaining to allotment of land, payment, discrepancies found in the execution of works, and FIR registered, if any.

As per a letter to the Authority, this is part of the ED’s enquiry against the ATS

Group under provisions of the Prevention of Money Laundering Act (PMLA), 2002.

The 63 companies comprise of firms executing mega projects in Noida such as ATS Apartment, ATS Buildcon, ATS Buildline, ATS Homes, ATS Infrastructure, ATS Township, ATS Real estate, ATS Dreamzone etc.

Getamber Anand, chairman of ATS Group, said he has not received any notice from the ED regarding the investigation. “I have not received any notice in this regard so far. It would be preemptive to say the ED is conducting an investigation against us. This is a routine exercise. There is also a CAG audit going on in the city. As there are multiple builders in Noida, the ED keeps asking for details from the Authority. We are not alone, then why are we being singled out? There is no case, no FIR against us. We are being targeted. ATS is completing its projects sooner or later,” Anand told The Indian Express.

The letter dated June 21 to Noida Authority CEO Lokesh M from Jvalin Tejpal, Deputy Director, ED Lucknow Zone, reads: “The Directorate is conducting an enquiry under the PMLA, 2002, into the ATS Group. In this regard, you are requested to submit details of the allotment of land to any of the group companies, either in its sole capacity as a bidder or as part of a consortium.”

It also seeks “details of payments (dues) made by the group companies and delays” as well as “details of discrepancies found in the execution of works in

violation of the terms of allotment, if any”.

Along with this, the letter states, the agency also sought details regarding whether cancellation of the allotment of the companies occurred. “(Provide) details of any other coercive action taken against the allottee companies. The above-mentioned information is sought u/s 54 of PMLA, 2002. It is requested that this information may be provided on or before 28.06.2024,” reads the letter.

CEO Lokesh M said he has not received a physical copy of the letter. “I will check if it is in the mail or not on Monday. I have not received a physical copy of the letter sent through post, if any,” he said.

The ED letter has also been marked to Manoj Kumar Singh, Infrastructure & Industrial Development Commissioner, Uttar Pradesh Government.
