Officials want to hide their identity: HC

The judge made the observation after East Municipal Corporation officials ignored court orders to attach the salary of an employee of the East Municipal Corporation.

Irked after repeated orders of the court to take action against a subordinate official were ignored and no inquiry was conducted, a city court has observed that government officials “deliberately want to hide their identity in order to save their skin for negligence on their part”.

The court of senior civil judge N K Laka has sent its order to Delhi’s chief secretary, DDA chairman and commissioners of the three municipal corporations to consider issuing directions that all subordinate officials — who receive any orders, warrants or notices from the court — give their full names and designations, so that the “negligent” officials can be identified and the work of the court is not stalled.

The judge made the observation after East Municipal Corporation officials ignored court orders to attach the salary of an employee of the East Municipal Corporation, who had defaulted on loan repayment to the State Bank of India. The bank had approached the civil court to get its money back and the court had directed that the salary of the employee should be attached.

Repeated warrants were sent to the officer of the assistant commissioner in Shahadara zone, but the salary of the official was not sent to court. The court issued bailable warrants against the DDO of Shahadara zone after he failed to appear before court to give an explanation for why the order was not followed. The court also observed that no inquiry had been conducted against the officials who had failed to take action on the warrant of attachment.

The civil judge has now observed that there were no records of the names of the officials who had actually received the warrants issued by the court and no inquiry could be conducted against the erring officials. The court also found that “government officials are always reluctant to disclose their name and designation while receiving the summons/process and they only put their initials”.

Laka, in his order, has said that the officials hide their identity so that they cannot be pulled up for negligence “in case the court process is not complied in time.” this, said the judge, “indirectly delays court proceedings”.

The civil court has also sent a copy of its order to the district judge, Shahadara, so that orders can be issued to the administrative branch of the courts to ensure that full names, designation and date is obtained from the receiving officer.
