‘Missing’ chargesheet: DCP summoned

A Delhi court has summoned Deputy Commissioner of Police Rajiv Ranjan to depose before the court on why a particular chargesheet was never filed in a case related to the 1984 anti-Sikh riots.

A Delhi court has summoned Deputy Commissioner of Police (DCP) Rajiv Ranjan to depose before the court on why a particular chargesheet was never filed in a case related to the 1984 anti-Sikh riots.

B S June,Special Public Prosecutor (PP) appointed by the High Court in February this year to examine the cases,said no court proceedings were conducted in the case of chargesheet related to FIR 67 that was filed at the Nangloi police station in 1987.

Ranjan was an investigating officer at the Nangloi police station at the time when the case was registered. According to the victims’ counsel H S Phoolka,a leader’s name figured in one of the two cases,but was never brought to the court’s notice.

FIR 67,the police claimed,was tagged with another FIR (number 418) filed in 1991. In case of the FIR 418 in 1991,a case was filed in the court. The police claim the chargesheet in the case of FIR 67 was ready and was clubbed with the 1991 case. June,however,found the chargesheet of FIR 67 was not filed in the court.

He filed an application to this effect in the Rohini court complex on April 1. On Wednesday,Additional Sessions Judge V K Goyal issued the notices summoning Ranjan to explain why the chargesheet was not filed.

Phoolka said: “It (the chargesheet) was not brought to the notice of the court. They just tagged it with other cases. Neither were witnesses examined nor were the accused tried. The name of the accused does not figure in the Special PP’s report but we have witnesses.”

At the Karkardooma court complex,where the hearing of the 1984 anti-Sikh trials have begun in the court of Additional Sessions Judge Sunita Gupta,Congress leader Sajjan Kumar again asked the court to direct the Central Bureau of Investigation (CBI) to provide the documents in the chargesheet to the accused in the cases.

The CBI,however,said the cases were registered after the investigating agency filed fresh cases as they related to a number of killings. The CBI added the defence’s fear that it would cause prejudice is unfounded as the CBI has not relied on what was mentioned in the chargesheets.
