The Delhi High Court on Monday issued notice to the Delhi government on a plea filed by a woman lawyer, who recently fought off an attacker who had entered her home.
The 26-year-old woman, who had to get stitches on her head, has now approached the court after her attacker was let out on bail by a trial court which reportedly did not find any head injuries in the medical records.
On May 27, the woman, who is a resident of Jangpura, was attacked by Mukesh, who entered her house and hit her on the head with an iron rod, before trying to tear off her shirt. He allegedly ran away after she raised alarm. According to police, Mukesh in his disclosure statement revealed that he had been stalking her for three months but she had “not noticed” him. The woman was taken to a nearby private hospital and given first aid before being admitted to the AIIMS trauma centre.

According to the plea filed before the HC, police, however, failed to add charges of attempt to rape (Section 376 read with 511 of the IPC) or disrobing (354 B) in the FIR, which only mentions sections 452 (trespass), 323 (causing hurt) and 354 (molestation) and 308 (attempt to commit culpable homicide) of the IPC. On June 5, a trial court granted bail to Mukesh after observing that the medical record did not show any head injury.
