i10 car’s tyre, rim gets detached in a month of purchase, Delhi consumer court asks Hyundai to pay Rs 2 lakh to owner

The complainant purchased the i10 car in September 2009 and his car had travelled just over 6,200 km when the incident occurred.

The Delhi State Consumer Disputes Redressal Commission has recently directed automotive manufacturer Hyundai Motors to pay Rs 2 lakh in compensation to a man whose vehicle’s rear tyre and rim got detached within a month of purchase while driving, due to which his i10 car met with an accident.

“…it is clear that the appellant/complainant got delivery of the car on 04.09.2009. Thereafter, the car suffered accident due to the tyre alongwith its rim came out of the shaft which shows poor workmanship on part of the respondents (Hyundai) on 03.10.2009 i.e. on the first month of the purchase of the car,” said Justice Sangita Dhingra Sehgal and Pinki (judicial member) of the consumer court on November 24, while passing the order.

The complainant, P R Meena, purchased the i10 car in September 2009 and his car had travelled just over 6,200 km when the incident occurred. He told the court that he was driving at a speed of just 65 km per hour.

Hyundai argued in court that the i10 did not have any manufacturing defects and the accident occured because the owner was driving the vehicle in a rough and negligent manner.

The consumer court, however, held that the complainant had suffered a lot of inconvenience and misery due to the improper functioning of the vehicle. “No purchaser of a new vehicle would ever think that he would be going to a garage/service station to get the vehicle repaired so often even if the repairs may be minor,” the court added.

Earlier in 2015, a district commission had also held Hyundai guilty of poor workmanship in the case and had awarded a compensation of Rs 80,000 to Meena. Dissatisfied with this compensation, Meena had later approached the Delhi State Consumer Disputes Redressal Commission.
