(Source: File)THE DELHI High Court Monday requested the trial court to expeditiously dispose of Baramulla MP Abdul Rashid Sheikh alias Engineer Rashid’s bail plea after the administrative side of the HC submitted that it has issued an order designating the trial court to try MP/MLA cases.
In light of the development, which formally breaks the deadlock that the trial court was facing over jurisdiction, Justice Vikas Mahajan also permitted Rashid to withdraw his petition in which he had sought the HC’s direction to the trial court to hear his case.
Rashid has been in judicial custody in connection with a terror funding case being investigated by the NIA since 2019, charged under UAPA. He was elected from Baramulla in the 2024 LS polls.
His bail plea had been pending with the trial court, which was awaiting instructions on whether an NIA court or a designated MP/MLA court should decide his plea. ASJ Chander Jit Singh reserved order on his bail plea in August 2024 and requested the district judge to transfer the case to a court designated to try lawmakers, observing Rashid was now an MP.
The Supreme Court, earlier this month, clarified that the specially designated NIA court can hear his bail pleas.
