With no stay on the trial against Kejriwal in the ED case in the alleged excise policy scam, the trial court is due to take up the case next on December 13.The Delhi High Court Friday refused to grant an early hearing date to former Chief Minister Arvind Kejriwal in his plea seeking quashing of a trial court order taking cognisance of the ED chargesheet against him in the money laundering case.
This means, the HC will hear Kejriwal’s plea as per the schedule on December 20.
With no stay on the trial against Kejriwal in the ED case in the alleged excise policy scam, the trial court is due to take up the case next on December 13.
While senior advocate N Hariharan representing the former Chief Minister pressed for advancing the next date of hearing before the HC, Justice Manoj Kumar Ohri Friday indicated that the same will not be possible owing to a large number of matters already listed before him.
Hariharan alternatively also requested the court to direct the prosecution to serve Kejriwal with their reply in advance, following which Justice Ohri orally instructed ED to do the same.
Kejriwal is seeking the quashing of the trial court’s order from July 9 where it had taken cognisance of the seventh supplementary chargesheet filed by the ED.
Relying on a 2024 Supreme Court verdict, he has contended that summoning of an accused “without any fresh/additional evidence in the supplementary chargesheet… is nothing but a review of the original order of summoning and as such abuse of the process of court”.
