Delhi HC grants interim bail to ex-MLA subject to him teaching at education centre

The Delhi high court on Monday granted interim bail to former MLA Asif Mohammad Khan in two cases registered at Shaheen Bagh police station for allegedly abusing police personnel subject to condition that he would render his services at an adult education centre run by any recognised NGO three days a week.

A single judge bench of Justice Dinesh Kumar Sharma further directed Khan to report to Station house officer, police station Shaheen Bagh every alternate day and will go there alone unaccompanied by anyone. The high court further directed Asif to”appear before the Secretary Delhi State Legal Services Authority (Rouse Avenue) on March 27 for impart adult education at a centre run by any of the recognised NGO’s for three days a week”. The court passed this direction after it was informed that Khan was an alumni of Jamia Milia Islamia University and was otherwise learned.

The high court further directed that if Khan is found indulging in a similar offence, the state would be at liberty to move application before trial court for cancellation of his interim bail. The court enlarged Khan on interim bail on a personal bond of Rs. 50,000 in each case, with one surety of like amount. The matter is next listed on September 6.

While hearing the matter, the high court said, “A person who has himself been an MLA, whose daughter is an MCD councillor, if he uses abusive language then what will others do”.

The high court noted that Khan was granted bail by Additional Sessions Judge Anuj Aggarwal in December 8 last year. According to police, the incident took place on November 25, 2022 at Shaheen Bagh’s Tayyab Masjid when Khan manhandled a police officer who asked him if he had the permission from the Election Commission to address a public gathering, the Indian Express had reported.
Khan’s lawyers, on the other hand, alleged he had visited the area after hearing news that AAP candidate Wajid Khan allegedly have Rs 50,000 to the ‘Imam’ of the mosque while his aides announced that a total of Rs 1 lakh will be handed over to the ‘Imam’ with a plea to vote for the party during the civic body elections, the Indian Express had reported.

Thereafter the delhi police lodged another case earlier this year under which it was alleged that Khan allegedly obstructed a public personnel in discharging public duty and abused him. It was also alleged that he incited the public against the police.

The trial court in January this year cancelled the Khan’s bail for violating the condition in its December order that he shall not commit offence of similar nature. Before the high court the Delhi Police opposed grant of interim bail arguing that Khan’s conduct has been consistent in attacking government servants in duty which is depreciable.

Khan’s counsel argued that he has been implicated in false cases as he is a political person and that he has not been convicted in a single case. Delhi Police opposed the bail and said that Khan will indulge activities.
