A session court in the Patiala House Court Complex has slammed officials of the Narcotics Control Bureau (NCB) for manipulating evidence and intimidating witnesses in a major drug case. Special NDPS judge Anu Grover Baliga pulled up the officials while acquitting three persons,who were allegedly involved in a major drug racket.
In 2008,the NCB had reportedly busted the syndicate with the arrest of a Nigerian woman and one Anju Tiwari,seizing Afghani heroin worth Rs 4 crore.
The agency claimed that Anjus husband Krishan Kumar Tiwari,who was in Tihar for offences such as kidnapping and
extortion,was the kingpin. It said that while in jail,he had formed a network with other drug traffickers lodged there.
In the course of arguments,NCB officials claimed that they had conducted the seizure in the presence of public witnesses,and had obtained confessions from Anju as well as her cousin,Rakesh Nath Tiwari. However,a handwriting expert from the defence proved the first contention wrong,stating that the signatures of the two witnesses were forged. When summons were sent to the two witnesses,the court was informed that the addresses mentioned did not exist.
The NCB counsel argued that even if the witness statements were set aside,the testimony of the officials should be enough to secure conviction of the accused. The court,however,dismissed this view. I am unable to agree with this contention,now that it has come on record that the investigating officers did not conduct the investigation in a fair manner,and even went to the extent of manipulating documents, the judge said.
The medical record of Rakesh from Safadarjung hospital showed that he had multiple bruises all over his body. The judge said this vindicated Rakeshs statement that he was beaten mercilessly by NCB officials,forcing Anju to give a dictated statement.
