Allahabad HC partly allows Talwars’ pleas

The Allahabad High Court on Friday partly allowed applications filed by Rajesh and Nupur Talwar.

The Allahabad High Court on Friday partly allowed applications filed by Rajesh and Nupur Talwar,who are standing trial for the murder of their daughter Aarushi and domestic aide Hemraj on the intervening night of May15-16,2008.

A single-judge bench of Justice Sudhir Agarwal accepted the plea of Talwars to have the sound simulation test report produced before the trial court. The test was conducted by the CBI on the issue of how the Talwars could not hear anything when the murders were taking place.

The court also accepted the Talwars’ plea for having the DNA worksheet (which will establish as to how the experts arrived on opinions in reports) brought on record.

Another request of Talwars,for producing the call detail records of two mobile phone numbers and one landline number of Talwars’ residence was allowed by the court.

The court rejected the Talwars’s plea seeking directions to the CBI to produce narco-analysis and brain mapping test reports of Raj Kumar,Vijay Mandal and Krishna — the three initial accused.

The court also rejected the plea to direct the CBI for producing the original report of two doctors,who had conducted autopsy on Aarushi and also inspected the alleged weapon of offence.

The court further rejected their plea to summon the Registrar of Supreme Court with the original record of a review petition filed by the CBI in the case earlier. The CBI Sessions court in Ghaziabad,where the trial is going on,had rejected these applications on June 18.

Didn’t notice anything unusual on terrace: Defence witness

Ghaziabad: Rajesh Talwar’s employee Vikas Sethi,who was present in the Talwar residence on the day the body of Aarushi Talwar was discovered,told a Ghaziabad Sessions court on Friday that when he went to the terrace to dispose off ice slabs and a mattress,he did not notice anything unusual. Sethi said he did not ask the Talwars if he should clean. “After we put the mattress on the terrace,we went to her (Aarushi’s) room. There was a lot of blood under the bed which was cleaned with a floor mat,” he said. The next hearing is on July 22.
