BJP MP Pragya Singh Thakur. (File Photo)A special court Wednesday stayed a bailable warrant issued against BJP MP Pragya Singh Thakur in the 2008 Malegaon blast case after her lawyers submitted that she has been hospitalised in Mumbai.
On March 11, the court had issued a warrant against Thakur for non-appearance in court and had kept it returnable by March 20.
Thakur’s lawyer J P Mishra told the court that while she was on her way to the city, she fell unconscious on the flight and was rushed to the nearest hospital on landing.
He sought a stay on the warrant, stating that she is in Mumbai and will remain present in court as soon as she is discharged.
The court said that the National Investigation Agency (NIA) has not filed a compliance report on the warrant as was instructed. The agency told the court its Bhopal and Ahmedabad branches were intimated about it but the warrant has not been served to Thakur.
“Considering the reasons put forth in the application, the execution of bailable warrant is hereby stayed till accused no. 1 (Thakur) gets the discharge from the concerned hospital… The accused no.1 to file discharge certificate after getting discharge from the concerned hospital,” special judge A K Lahoti said.
The court is currently recording statements of the accused after the prosecution completed its submission of evidence.
