Won’t drop prosecutor without HC nod: State

Jayalalithaa is accused of amassing illegal assets worth Rs 66.65 crore.

The Karnataka government Friday backtracked on its decision to directly remove the public prosecutor in the corruption case against Tamil Nadu chief minister J Jayalalithaa.

The government’s counsel,Attorney General G E Vahanvati,informed the Supreme Court that it will withdraw the August 26 notification to take G Bhavani Singh off the case as it was issued without consulting the Chief Justice of the Karnataka high court. He told a bench led by Justice B S Chauhan that the file on Singh’s removal and a fresh list of names of senior lawyers would soon be sent to the chief justice for his approval.

In his submission,Vahanvati mentioned that then acting chief justice of Karnataka had accepted the resignation of B V Acharya as the prosecutor and appointed Singh earlier this year even though the latter was not among the four names recommended for appointment.

Vahanvati,however,did not mention whether Singh would be reinstated. Singh,in his response to the court,had said he would want to continue as the prosecutor in the case,which is being heard in a court in Bangalore.

Senior advocate Vikas Singh,appearing for DMK leader K Anbazhagan,on whose plea the Supreme Court had transferred the case from Tamil Nadu to Bangalore in 2003,contended that Singh should not reinstated.

Jayalalithaa’s counsel Mukul Rohtagi said it was a political battle that is being fought in the court. The prosecutor,he said,was appointed on February 2 but now an attempt is being made to remove him to keep the pot boiling as elections are around the corner.

Jayalalithaa is accused of amassing illegal assets worth Rs 66.65 crore during her first term as chief minister between 1991 and 1996. She has claimed the case was slapped on her by the DMK government for political reasons.
