Acts on directions of CAT; next hearing to occur on August 30

Having come under the scanner of the Central Administrative Tribunal (CAT),the UPSC today chose to defer the interview for the post of the next director-principal of Government Medical College and Hospital,Sector 32 (GMCH-32). Avoiding any adverse order from the Tribunal,the UPSC undertook that in view of the latest developments,it has decided to defer/ postpone the Selection Committee meeting scheduled to be held on August 16 in the office of the UPSC.

No date has been specified by the UPSC as to when will the interview take place now. The case will now come up for resumed hearing on August 30 and till then the interview is not likely to take place.

In its orders passed today,the Tribunal accepting the undertaking of the Union Public Service Commission (UPSC) placed on record,and adjourned the case for August 30. Also,the bench stated that this application will be heard along with that of Dr S K Singh which is coming up on the same day,of PGIMER who was earlier provided a relief by the Tribunal and was to appear for the interview on August 16.

Going a step further,the counsel for UT Administration even said in the court that the UT administration has no qualms in including the names of the five applicants ( the petitioners) for consideration for the said interview.

In its directions on Monday,the Tribunal in its three-page order had observed that in the light of the facts and circumstances of the case we would request the UPSC counsel to have instructions about desirability and feasibility of considering the deferment of the personal talk to enable the parties in this application to file its counter replies on merits and have adjudication in the meantime.

In view of the facts,the counsel for the respondents in this application assure that they would be able to file counter replies at a short notice,we would request the UPSC for a deferment by an only about a fortnight.

The tribunal is not unmindful of implications of a last minute deferment at the same time that is the only course which may enable the parties to file their pleadings. It will also enable the UT administration to reconcile the apparent variation of stance.

Five GMCH-32 faculty members — Dr A K Attri,Dr Atul Sachdeva,Dr S K Garg,Dr Ram Singh and Dr Anju Huria — filed the petition on August 13 in the tribunal seeking a level playing field as far as the contest for the next director-principal is concerned. Prior to that Dr S K Singh,a Urologist from PGIMER had also got relief from the Tribunal after the UT Administration,despite him fulfilling the eligibility criteria,did not forward his name to the UPSC for consideration. After CAT’s order,his name was sent to the UPSC for consideration for the coveted post.
