Undertrial flees from custody

There was high drama at Madhya Marg on Monday after an undertrial,accused of rape,managed to flee after overpowering the constable accompanying him. The accused,Deepak (20) was being shifted back to Burail Jail from GMSH-16 — where doctors had examined him after he complained of abdomen pain — when he managed to escape at around 1.30 pm. The UT Police had arrested Deepak in a rape case on July 11,last year.

Constable Sanjay and Assistant Sub-Inspector Kuldeep Singh have now been suspended following the undertrial’s escape. A case has also been registered against the two officials under Section 223 (escape from confinement or custody as a result of negligence by a public servant) of the Indian Penal Code in the Police Station Sector 3.

Sources at the Model Jail in Burail said Deepak was brought to the Government Multi-Specialty Hospital (GMSH) in Sector 16 after a visiting doctor had adviced authorities to get an ultra-sound done on him. According to police sources,family members of the undertrial visited him at the hospital on Monday while he was being examined by doctors. Deepak was made to undergo an ultra-sound.

After the tests,the undertrial and the constable accompanying him were waiting for the jail bus to pick them up at the bus stop in front of Home Science College,Sector 10. As the bus approached,Deepak managed to overpower constable Sanjay and run towards Sector 16. He is a resident of Sector 15. The constable ran after him but in vain. Constable Sanjay sustained minor injuries in the incident.

Police then raided the residence of the undertrial in Sector 15-D. His brother-in-law was also rounded up for questioning. DSP (central) Ashish Kapoor said a case has been registered at the Police Station Sector 3 and added that police are investigating.

Deepak was arrested by the officials of Police Station Sector 39 following the rape of a 15-year-old in a house in Maloya. Police had registered a case under sections 363,376,366 and 120-B on July 5 last year.

“A few more persons were named in the FIR who are absconding. Deepak was arrested on July 11 and was remanded to judicial custody on July 1”,” said a police official. The accused is facing trial in the court of Additional District and Sessions Judge,Surinder Singh Sahini and his case was listed for Tuesday.
