Two acquitted of rape charges in two separate cases after victims turn hostile

A Mohali court on Thursday acquitted a man of the charge of rape after the victim turned hostile.

Vijay Kumar,a resident of Kurukshetra,was acquitted by the court of Additional District and Sessions Judge Jaswinder Sheemar of rape charges on Thursday following a reversal in the statements of both the victim and her brother.

Kumar had been booked in April 2011 under Section 376 of the IPC. According to the FIR,the complainant,who was in her early thirties and a resident of Karnal,fell ill following which a woman named Krishna who was a family acquaintance took her to Derabassi for treatment.

Once in Derabassi,Krishna took the victim to a house and asked her to wait for the doctor,leaving her alone in a room. However,the accused,whom she had never seen before,turned up at the spot and raped her,she had alleged. The court had booked Kumar on rape charges. On Wednesday,the victim turned hostile.

Meanwhile,the court acquitted another person of charges of kidnap and rape on Tuesday. Avtar Singh,alias,Sunny,a resident of Dharamgarh,was acquitted by the court after the victim,a minor,turned hostile.

Sunny was booked in June,when the victim’s father approached the police alleging that his daughter had been kidnapped from their house in Malakpur village. Later,it was found that the girl was living with Sunny in a rented accommodation in Rajpura. Since the girl was a minor,a case of kidnap and rape had been registered against Sunny under Sections 363,366A and 376 of the IPC after medical reports confirmed rape.

Recently,both the victim and her father retracted from their statement following which Sunny was acquitted.
