RLA says challan those without HSRP,cops ask under which section

Chandigarh’s traffic police is clueless as to under which section of the motor vehicle Act they should challan the offenders.

Registration and Licensing Authority (RLA),Chandigarh is issuing notices every month to the owners of the vehicles with registration numbers belonging to a particular series,to get High Security Registration Plates (HSRP) affixed on their vehicles. RLA is further instructing the UT Traffic Police to challan those who fail to comply with the order. However,Chandigarh’s traffic police is clueless as to under which section of the motor vehicle Act they should challan the offenders.

The RLA,on November 29,had issued a notice which says,“The owners of the vehicle having registration number of CH01AP series shall apply for affixing of HSRP at their respective offices with the request on plain paper inserting the detail of chassis number,engine number,make,model,along with a copy of registration certificate of the vehicle and a copy of valid insurance within one month starting from December 2,2013. In case if the owners of the vehicle of above series do not affix HSRP plates within the stipulated period,the Traffic Police,UT,Chandigarh will be asked to initiate the process for challaning of their vehicle”.

The SSP,Traffic and Security,Maneesh Chaudhry said,“Around two months ago,the RLA had asked us to issue challans to persons driving vehicles without the HSRP. We sent the licencing authority a letter seeking a copy of the Supreme Court order which lays down the said provision. We also asked them the section in the Motor Vehicle Act under which we should issue the challans as currently there is no such section available that allows the traffic department to issue challans in such cases.”

On October 23,RLA issued a notice in which the owners of the vehicle having registration number of CH01AQ series were instructed to get high security plates fixed within a month starting from October 28. Those failing to do so were suppose to be challaned.

RLA has already written to the traffic police to challan those who have failed to get high security registration plate (HSRP) for the registration number belonging to CH01AR from November 1.

However,in the absence of clarity on the section under which they would issue challans,the traffic police has not initiated the process.

“They should read the order of the Supreme Court which has clear directions regarding the affixing of the HSRP. We have already written a letter to the traffic police to start issuing challans against those vehicle owners who were instructed to get the HSRP with in a stipulated time,but they have failed to do so,” an RLA official said.
