The Police Complaints Authority (PCA) has recommended immediate suspension and departmental inquiry against Sub Inspector Gurdev Singh and constable Kaptan Singh for gross misconduct and abuse of power. The authority has also recommended appropriate disciplinary action against DSP (Lines) Jagbir Singh,who was found to not have conducted himself in a just and impartial manner.
The directions were passed on Friday on the complaint of Advocate Ajay Sood who had alleged that he was slapped and manhandled by constable Kaptan Singh posted at an Indian Oil petrol pump run by the Police Welfare Society in Sector 33 on May 5.
The PCAs latest order reads,On the considerations of the entire facts and circumstances of this incident,the police officers are found to have misconducted themselves. SI Gurdev Singh failed to record the statement of the complainant and send him for medical examination. He acted in a biased and malafide manner and supported the misdeeds of Kaptan Singh at the time of the incident.
The order further states,DSP (Lines) Jagbir Singh,being a senior police officer and also being the officer-in-charge of the petrol pump,was expected to intervene immediately after the incident. He failed to look into the incident in a fair and dispassionate manner. He has instead supported Kaptan Singh. He has drafted an inquiry report which does not inspire trust and confidence.
The inquiry report by Jagbir Singh appears to be totally one-sided and biased. He recorded the statements of four officials,three petrol pump employees and three strangers. The statements of NK Nanda were not recorded though they were fully aware of the entire episode. The story of initial non-payment and subsequent payment and issuance of receipt appears to have been introduced in the inquiry report to save police officials,Kaptan Singh and Gurdev Singh for gross misconduct is absolutely unbelievable, reads the order.
The recommendation was made by retired Judge N K Aggarwal,retired IPS officer K J Singh and Joyshri Lobo.
