Mohali-based society fined for non-refund of booking amount

Kamal Jeet had deposited the amount as earnest money with the society to purchase a 100 square yard plot in Sector 111-112. He alleged that the project did not get the approval of government authorities as assured by the society’s official and hence,no loans were being sanctioned by the financial institutions. Rather than clearing the air for him on issue of government approval and loan sanction despite several requests,the society approached him for making further payments. Kamal Jeet then decided to cancel the purchase and asked for a refund from the society. He was initially assured that the refund would be made within seven days,but never got the money back,he accused.

However,it was contended by the society that though he had withdrawn from the membership of the society,he had transferred the plot to someone else and hence it was not liable to pay any refund.

Finding no evidence on record about a request of such a transfer being conceded by Skyrock,the forum maintained that it was “bound by its own acts of promise” to refund the money.
