Debarred for five years from central deputation, Haryana IPS officer alleges harassment, seeks FIR

The MHA also debarred the officer from central deputation for a period of five years, apart from debarring him from being considered for foreign assignment/consultancies abroad during the period of debarment.

Debarred for five years from central deputation and foreign assignments for failing to take charge of the post assigned to him, Haryana IPS officer Rajender Kumar Meena has moved a representation with state Chief Secretary Sanjeev Kaushal seeking registration of an FIR against Additional Chief Secretary (Home) TVSN Prasad accusing him of harassment, a charge denied by the latter.

Prasad had asked Meena to relinquish charge days after the Union Ministry of Home Affairs (MHA) had debarred him from central deputation for five years with the former stating that the officer concerned should have shared his grievance, if any, with him and the issue can be resolved amicably, even now.

In the representation made on October 23, Meena had referred to at least two episodes to substantiate his allegations of harassment against Prasad. The latest one relates to the matter of his central deputation. The MHA on October 4 this year had informed the state government that as the officer (Meena) had failed to take charge as SP, Bureau of Police Research and Development (BPR & D) on central deputation, the competent authority had approved the cancellation of this appointment.

The MHA also debarred the officer from central deputation for a period of five years, apart from debarring him from being considered for foreign assignment/consultancies abroad during the period of debarment.

According to the 2011 batch IPS officer, the office of home secretary received the MHA letter on October 9 but still he was “unexpectedly” asked to “relinquish the charge” on October 18. Meena further informed the chief secretary that he met the home secretary in the afternoon on the same day to request him to review his orders.

“…but he (TVSN Prasad) was not willing to listen to me and till date he has not cancelled and reviewed the said orders… I also requested him that it would be a huge embarrassment for me being an IPS officer to be relieved like this whereas I cannot join on which already cancelled orders for central deputation post of SP (BPR&D) after relinquishing from the state govt in such manner,” Meena alleged in the representation.

According to Meena, earlier the home secretary had “harassed him by posting him as the fourth ADC to the governor of Haryana when two ADCs had already been posted there – one from the Air Force and the other an IPS officer”. Meena alleged: “There was no work for 3rd/4th ADC in Raj Bhawan.”

In the representation, the IPS officer urged the chief secretary to order registration of an FIR against the home secretary while accusing him (Prasad) of “committing atrocities against him by conspiring with some other officers who are hostile towards him which is in public knowledge of all IPS officers of Haryana”.

Meena added: “All documentary pieces of evidence will be provided during the investigation of the case.” Meena has also marked a copy of the representation to the President of India, chairman of National Commission for Scheduled Tribes, Haryana governor, and state home minister.

On the other hand, denying the allegations of harassment, Prasad claimed that the IPS officer has not been relieved and he still stands appointed as SP, Information Technology for the state police.

The official records show the state government had put the services of Meena at the disposal of the central government for a period of five years. An order issued by Prasad on October 18 had asked the IPS officer “to relinquish the charge with immediate effect” and report for duty at the place of the new assignment (BPR&D) to comply with the orders of the MHA issued on June 14 and July 14 this year.

On Wednesday, Prasad told The Indian Express: “By issuing an order, we just completed our process to enable the officer to join the central deputation. I assured him that the debarment may still be cancelled if he is willing to join the central government. But when he insisted on staying in the state and made a representation about the same, we sent it to the state government for a final call. However, the state government had earlier rejected his similar representation. But now the situation has changed after the debarment by the MHA for a central deputation.”

Prasad also said: “There was nothing wrong in appointing the IPS officer to the Raj Bhawan as ADC to the governor during the leave period of one of the two ADCs there. The posting was done as per the administrative requirements.”
