Additional District and Sessions Judge Raj Rahul Garg on Monday sentenced Dr Swapna Singh to life imprisonment for murdering her husband Mandiv Sapra at Hotel Mountview in 2003. The court has also imposed a fine of Rs 75,000 on the doctor.
Dr Singh was convicted under Section 302 (murder) and 201 (destruction of evidence) of the IPC.
While pronouncing the order,the court ruled: She is the sole bread winner in her family and has a son to support. Her son is only 18-year-old and has just joined B.Com in a Delhi College. He is solely dependent on her financially and emotionally. She poses no danger to harmonious and peaceful co-existance of society,so lenient view may be taken.
The court also said that the public prosecutor did not argue for awarding the capital punishment to the convict as she is a woman. The defence counsel,too,did not argue much on the nature of punishment,the court added.
I hereby sentence Swapna Singh to undergo life imprisonment for committing an offence punishable under section 302 of the IPC, said the court in its 80-page judgement. But the court also made it clear that it was not the rarest of the rare case.
Sapras body was found in a room of Hotel Mountview on July 11,2003. Subsequent police investigations pointed towards Dr Swapna,who had strained relations with the deceased.
