CBI court issues bailable warrants against DSP for ignoring summons; slams CBI Imphal chief for defying orders

It was learnt by the court that summons sent to DSP Ram were received back duly served through email.

Learning that the head of branch of CBI’s ACB (Anti-Corruption Bureau), Imphal (Manipur), is not permitting a DSP (Deputy Superintendent of Police) to appear before the Chandigarh court for examination in a graft case registered in 2017 against a Chandigarh Police Sub-Inspector (SI), a special CBI court Friday called the “approach of head of branch, CBI ACB Imphal, in violation of court’s order”, and said that it “cannot be appreciated”.

The special CBI judge, Alka Malik, also issued bailable warrants of arrest in the sum of Rs 15,000 of CBI DSP Mohinder Ram, who did not appear before the court.

The CBI court was hearing a graft case against Chandigarh Police S-I Mohan Singh, then posted at Sector 31 police station, who was arrested by CBI for allegedly demanding a bribe of Rs 9 lakh and accepting Rs 2 lakh from a Manimajra resident, Prem Singh Bisht.

The case, which is at the stage of trial evidence, Friday came up for hearing before the CBI court of Alka Malik, Additional District and Sessions Judge, Chandigarh.

During the hearing, Manjeet, a prosecution witness, was present for his cross-examination, but was not examined as the defence counsel of Mohan Singh pleaded that cross-examination of this witness should be conducted on the day when DSP Mohinder Ram, another prosecution witness, will be examined. However, DSP Ram did not appear before the court on Friday.

It was learnt by the court that summons sent to DSP Ram were received back duly served through email. However, an oral request on his behalf was received through naib court that “he is not being permitted by the head of branch, CBI ACB Imphal, to appear before this court”.

The court said, “Such an approach of head of branch, CBI ACB Imphal, is in violation of this court’s order and thus cannot be appreciated. Consequently, this request is declined.”

The court observed that as per records, DSP Ram is being summoned in this “Old Action Plan Case” pertaining to the year 2018, for the purpose of his cross-examination for about one year by now, but he has not appeared.

The court noted that on November 21, 2024, he was served, but he had sent his request which was granted by this court. Since then despite sending several summons to DSP Mohinder Ram, he has not appeared before this court and various requests have been received on his behalf or on behalf of head of branch, CBI ACB Imphal, directly in this court or through head of branch, CBI ACB Chandigarh.

“It is thus evident that this witness is not appearing in glaring defiance of the orders of this court. Let he be now summoned through bailable warrants of arrest in the sum of Rs 15,000 with one surety in the like amount for August 4, 2025,” ordered the court.

The court also directed that the head of branch, CBI ACB Chandigarh, is under direction from this court to ensure service of bailable warrants on this witness through a specially deputed officer.

“Necessary intimation in this regard be also sent to head of branch, CBI ACB Imphal, to ensure service of process on the witness as well as to ensure his presence before this court on that day positively. It is made clear that non-compliance of court order shall be viewed very seriously,” said the court of Alka Malik.
