The Central Administrative Tribunal (CAT) Wednesday dismissed an application filed by Balbir Singh,Inspector CBI,finding the challenge made to his transfer as devoid of merit. The Tribunal has found nothing amiss in the transfer orders of Balbir Singh. The Court also upheld transfer orders by the CBI Head Officer of Inspector Balbir Singh.
After looking at the facts and circumstances,it is held that there is no legal infirmity in the impugned orders of transfer dated April 29,2013,warrant interference of the court,no other point has been raised. Accordingly,the application is dismissed being devoid of merit, reads the judgment passed by Sanjeev Kaushik,Member of the Tribunal.
Sumeet Goel,counsel for CBI said,The orders for Balbir Singhs transfers have been upheld by the judge. The inspector was also not able to produce any documents to corroborate his claims in the court. Instead,the CBI was forced to show the court files with confidential documents of the agency.
Inspector Balbir Singh,who claimed to be a whistle blower had alleged that Deputy Inspector General (DIG) of CBI Mahesh Aggarwal had pressurized him (Balbir) to help an accused in a trap case.
Later,Balbir Singh had filed an additional affidavit alleging that Mahesh Aggarwal had tipped off relative of Vijay Singla,nephew of former Union Railway Minister Pawan Kumar Bansal about the raid by Delhi CBI. He had also alleged that raid at Vijay Singlas residence was delayed by three hours by the DIG which helped his family to destroy the evidences.
None of the accusations have found favour with the Tribunal.
Inspector Balbir Singh also alleged that DIG helped Rajiv Gupta,a Joint Commissioner in the Chandigarh Municipal Corporation who was to allegedly share a siognificant amount of graft money,in a case against an MC patwari.
Inspector Balbir had claimed to be one of the members of the raiding party in that case.
Rubbishing his claims,the CBI had however responded that Balbir Singh had nothing to do with the trap case.
