Bulk SMS service slow,forum orders refund

Is your SMS pack very slow? Take inspiration from a Tricity resident who has won his case against a local company on the ground that the bulk SMS pack provided to him was slow in delivery. The case was filed by Pawan Malhotra of Pacific Holidays in Sector 34-A. In his complaint to the UT Consumer Disputes Redressal Forum,Malhotra stated that in April 2010,he availed the services of a company in Sector 17 for bulk messages and to create his firm’s website. Malhotra stated that he paid the company Rs 25,060 for the purpose.

Malhotra claimed he later observed that the delivery date of the SMS service was very slow. He repeatedly complained to the company in this regard but there was no improvement,prompting him to file the case in the Consumer Forum. Despite a notice being served by the court,the company did not send its representative to contest the case. Hence the Forum delivered an ex-parte order regarding the complaint.

After considering the complaint submitted by Malhotra,the Forum observed that the complainant obtained bulk SMS and website services from the opposite party,but did not receive satisfactory services despite repeated requests. The Forum held that this amounted to deficiency in service on part of the company.

In this light,president of the Forum PD Goel and member Rajinder Singh Gill directed the company to refund Rs 25,060 to the complainant. The Forum also directed the company to pay Rs 5,000 to the complainant as compensation for mental agony and harassment,and Rs 2,500 as litigation costs.
