Three SIB officers quizzed by CBI claim they had no role to play

Agency also questions Chudasama lawyer

The three Subsidiary Intelligence Bureau officers,named in the chargesheet of the Ishrat Jahan encounter case,were interrogated by the CBI last week — the third time since the agency started probing the case. These officers had earlier been examined on May 29 and June 1. DSP G Kalaimani,who reportedly interrogated the trio,‘advised’ them to “either speak the truth or be prepared to go to jail”.

The CBI is trying to collect evidence and statements of persons involved in the case before filing the supplementary chargesheet. In 2004,Ishrat Jahan,Javed Sheikh,Zeeshan Johar and Amjadali Rana were killed in an encounter allegedly carried out “jointly by Gujarat Police and SIB,Ahmedabad” as per the CBI chargesheet. The three officers reportedly told Kalaimani that “they were ready to go to jail but had no role in the encounter”. These officers were identified in the chargesheet as Rajiv Wankhede,T Mittal and M K Sinha. The chargesheet,filed on July 3,named these officers and their former boss and now retired special director Rajinder Kumar for alleged abduction of the victims and illegal confinment.

The three officers were reportedly given a questionnaire to answer regarding the encounter. Some of the questions were — when was the intelligence input generated and what were the contents of the input; on whose instructions was the operation carried out; how were Johar and Rana (two alleged Pakistani terrorists) brought to Gujarat; how were Ishrat and Javed brought to Ahmedabad; how had the SIB procured the AK-47 rifle and revolvers?

The chargesheet stated that assistant central intelligence officers (operations) Rajiv Wankhede and M K Sinha allegedly abducted Ishrat and Javed on July 12,2004,from Vasad toll booth in Anand district. These officers were accompanied by suspended DSP N K Amin and Tarun Barot. It stated that on May 26,2004,a DCB team,including Amin,Barot and I K Chauhan,with the help of Sinha and Wankhede abducted Amjadali from Gota crossing.

“The CBI doesn’t have enough evidence to file supplementary chargesheet against Kumar. They are struggling to find material evidence against him,” sources said,adding that the agency may re-examine him soon. On Tuesday,the CBI questioned advocate Rohit Verma,lawyer of suspended police officer Abhay Chudasama in the Sohrabuddin case.

Verma has been Abhay’s lawyer for the past two years,before the trial moved to Mumbai. Verma said,“I’ve been questioned and my part of statements is over.”
