Janata Dal (United) MLA from Jhagadia Assembly constituency in Bharuch district has issued a notice to former minister Amit Shah,IGP-DGP Gyanendra Malik,police inspector Mini Joseph,Bharuch district collector and the state chief secretary,accusing them of conspiring to eliminate him in 2005. Chotubhai Vasava sent the notice through his advocate Dhiraj Parmar on Thursday. Vasava happens to be the lone JD(U) MLA in the Assembly. Amit Shah,who was arrested and is facing trial in the Sohrabuddin Sheikh fake encounter case,is on bail. He is currently BJPs national general secretary and the partys in-charge of UP. Speaking to The Indian Express over phone,Vasava said: I would soon be moving the Gujarat High Court,seeking a CBI probe into the conspiracy hatched by Shah and Malik,along with others,to kill me in an encounter in 2005. He moved court against Shah and the others after being acquitted on October 18 by a Ankleshwar court in a murder case,in which he was arrested in 2005. Vasava has been representing Jhagadia in the Assembly for about 25 years. Giving details about the case,he said that an adivasi youth named Bhuderbhai was murdered in 2002. Four persons were arrested for the murder and all were convicted. Later,15 more people were held in the same case. But they were subsequently acquitted. However,in 2005,a police team,led by police sub-inspector Mini Joseph,raided Vas-avas house and arrested him. I was taken to the office of Bharuch SP Gyanendra Malik. I was told that the murder had taken place at my behest. Meanwhile,Malik got a call from the then Minister of State for Home Amit Shah,saying,Is Chotu ko thikane laga do (eliminate him), Vasava said,adding that he could hear the conversation because Malik had switched on the speaker phone. Then Malik replied by saying,I have got Vasava in my office. I am just looking for a suitable place to complete the job, Vasava alleged. The following day,I appeared in a magistrates court in Ankleshwar,where ny advocate Dhiraj Parmar told the court that the police were conspiring to kill me in the Virwadi murder case,in which I played no role. Even the then district government pleader submitted that there was no evidence against me in the murder. I did not get bail and was sent for treatment to Bharuch Civil Hospital due to my illness. Vasava said that two months later,when he was still in the hospital,he got bail from the Gujarat High Court. Even the widow of the the murdered youth,Kapilaben,made a statement that I was not involved, Vasava said. However,the trial went on. I was finally declared innocent and acquited on Ocotber 18 this year, he said. Vasava has also been demanding a separate state comprising the tribal belt in Gujarat and adjoining Maharashtra and Madhya Pradesh. He said that the case has caused a lot of adverse political impact on his life and his other party candidates in the tribal belt. Though I won the Assembly election even after this allegation,my total vote count dropped drastically and all the candidates of all my party lost the elections, Vasava said. But Gyanendera Malik,who is currently heading the states Anti-Corruption Bureau refused to comment. Meanwhile,Amit Shah denied the allegations. He said,There has been no conspiracy. Vasava was arrested in an old case of murder on court orders. Charges of conspiracy against me are totally false. Mini Joseph said she had not yet received the notice. But the allegations of conspiracy are a total lie. Vasavas counsel,Dhiraj Parmar,said that only a probe by CBI or an independent agency can bring justice to Vasava. He said he would move the High Court,seeking a high-level probe into the incident.
