Sabarmati Jail authorities withdraw ‘application’ on Vanzara questioning

The application was withdrawn by the jail authorities after the court asked them if they wanted to challenge the CBI magisterial court’s order.

The Sabarmati Central Jail authorities on Wednesday withdrew its “application” before a CBI sessions court in which it asked the court as to how long suspended IPS officer D G Vanzara would be questioned by the CBI inside the jail in connection with the 2004 Ishrat Jahan fake encounter case. The application was withdrawn by the jail authorities after the court asked them if they wanted to challenge the CBI magisterial court’s order that allowed CBI to interrogate Vanzara inside the jail.

The “application” of the jail authorities was moved in the name of Superintendent of Sabarmati Central Jail on Tuesday. Immediately,the court had issued notices to the jail authorities,CBI and Vanzara while posting it for hearing on Wednesday.

The jail authorities on Wednesday informed the court that they had submitted the “application” only to take “guidance” from the court since the original order allowing CBI to interrogate Vanzara in the jail was given by a Special CBI magisterial court (Additional Chief Judicial Magistrate). The authorities had stated that since the case was committed before Sessions court for trial from the magisterial court,there was a need to modify the order.

The Sessions Court,presided over by judge Gita Gopi,told the jail authorities that there was a law allowing CBI to continue questioning Vanzara in the jail till someone challenges the subordinate court’s order. The court further asked the jail authorities if they wanted to challenge that order. To this,the jail officials said “no” and subsequently chose to withdrew the application. Following this,the court disposed of the “petition” as withdrawn.

“We submitted the application as a procedural move to inform the Sessions Court about his questioning. We had sought guidance from the court but it put our application as prayer and was kept on the board. Since we have no objection to CBI questioning Vanzara,we withdrew our application,” said a jail official present in the court.

Vanzara has been reportedly questioned by CBI for more than five times in the past two months.

Vanzara is a key accused in Ishrat Jahan encounter case as well as Sohrabuddin Sheikh and Tulsiram Prajapati fake encounter cases.
