Delhi court dismisses plea to prosecute Patkar
New Delhi: A Delhi court today dismissed an application seeking prosecution of Narmada Bachao Andolan (NBA) leader Medha Patkar for allegedly filing fake medical certificate to seek exemption from personal appearance in two defamation cases. Arguments on perjury application heard. Documents perused. Application is dismissed, Metropolitan Magistrate Munish Markan said while dismissing the plea of one V K Saxena. Saxena did not appear in the court today, and was represented by his counsel, who sought adjournment for advancing arguments on the plea, which says Patkar had taken exemption from personal appearance on March 3,2009 on the basis of a false medical certificate issued by a Maharashtra hospital. The court fixed the matter for hearing the arguments on issuance of notices in the two defamation cases filed by Saxena and Patkar against each other. It is a sponsored litigation. It is correct that I took part in a dharna at Nandurbar in Maharashtra. But I was advised against travelling long distances and because of this I could not appear before this court, said Patkar through her lawyer,V K Ohri.
Saxena, the president of the National Council for Civil Liberties (NCCL),had questioned the veracity of the medical report claiming Patkar was busy staging a dharna at the collectors office at Nandurbar that day. Earlier,Patkar had filed a criminal defamation case in Delhi against Saxena in 2000 for allegedly publishing advertisements against her and the activities of NBA.
Saxena had also filed a defamation case against her in Ahmedabad in 2001 for accusing him of making payments to an NGO in Malegaon. Both the cases were transferred to Delhi by the Supreme Court on Patkars plea. Then on April 7,2003,the court had dismissed her complaint for her non-appearance,which was revived on September 1,2006 after she approached the Delhi HC. Both the cases are at pre-summoning stage.
