A larger bench of the Gujarat High Court on Wednesday upheld the division benchs order to remove Saurashtra University registrar Gajendra Jani from the post for lacking qualification and experience.
Earlier last year,Governor and Chancellor Dr Kamla Beniwal had ordered Janis removal. Subsequently,the SU Syndicate rejected the order with five BJP-affiliated members voting against the Chancellors direction and three Congress-affiliated ones voting in its favour.
Later,senate member Dharam Kambaliya moved the HC with a petition to suspend Jani and the court ruled in Kambaliyas favour.
Following this,the university appealed to the court to stay the order. In July last year,a division bench headed by Chief Justice S J Mukhopadhyay refused to stay the order and asked the petitioner to move a larger bench.
Later,the syndicate took away the charge from Jani but did not remove him from the post.
Congress leader and syndicate member Nidat Barot said the court observed that Jani was not qualified and lacked experience for the post of registrar and that the Governor was well within her rights to order his removal.
The Governors decision was based on findings of a three-member committee,which was formed in 2011 to look into a complaint filed by the Congress challenging Janis appointment made in May 2007.
Congress leaders had expressed doubt that the qualification documents produced by Jani were not genuine.
As per the documents produced by Jani,he did LLB from a Porbandar college between 1999 and 2003.
He had also produced documents showing he pursued Masters in Social Work from SU between 1999 and 2001. Besides,he had produced a five-year (1999-2004) experience certificate as Chief Executive Officer with Rajkot-based Gitanjali College,which is owned by his brother.
Pointing out that the to-and-fro distance between Rajkot and Porbandar is around 500 km,the Congress had questioned how did Jani manage to do a full-time course at Porbandar along with a masters programme at SU while executing responsibilities as CEO of a college in Rajkot.
