The Gujarat High Court on Monday reserved its judgment on a petition challenging a government resolution under which Class X & XII students pursuing their studies in Urdu,Sindhi,Marathi,Tamil and other mediums are being given their examination papers in English,Gujarati or Hindi language and the students have to answer the same in their respective languages.
The HC reserved its judgment after the Gujarat Secondary and Higher Secondary Education Board submitted an affidavit saying since a few schools offer studies in those languages,they are facing difficulty in finding reliable paper setter/translators in those languages. And this,it added,might jeopardise the confidentiality aspect and interest of meritorious students.
In spite of this difficulty,the Board is arranging for the assessment of the answer-sheets in different languages by appointing examiners/moderators,but so far as the paper setter/translators are concerned,it would be difficult to find a teacher whom the Board can rely upon over the aspect of confidentiality. If such translators/teachers leak the papers,the future of lakhs of students will be at stake, the board stated in its affidavit opposing the petition.
The petition has been moved by advocate Shamshad Pathan on behalf of voluntary organisation Jan Sangharsh Manch,which contended that the resolution is irrational,arbitrary and unconstitutional.
The students,Pathan contended,who have studied throughout in their mother tongues cannot understand the questions in Gujarati,Hindi or English and consequently cannot answer either in their own language or in any other language.
The petitioner has demanded that the students studying in Urdu,Sindhi,Marathi,Tamil etc. must be given question papers in their respective languages and they also must be allowed to write their answers in the same.
The board also said the petitioner has no locus standi in the matter as none of the persons directly concerned have approached the court.
