HC throws out tainted SU registrar Jani

A Gujarat High Court Bench comprising Chief Justice S J Mukhopadhyay on Tuesday ordered to take away charge from Saurashtra University registrar Gajendra Jani with immediate effect. The Bench passed the order in response to an April 7 plea by SU Syndicate Member Dharmesh Kambalia,challenging Jani’s academic experience and qualifications for the post.

Further hearing in the case has been slated for July 14,when the HC has also summoned SU Vice-Chancellor Dr Kamlesh Joshipura.

Following the court order,SU authorities have now appointed Examination Controller Jagdish Mantora as the in-charge registrar.

Senior Syndicate member Nidat Barot said: “Responding to the plea by Syndicate Member Dharmesh Kambalia,the HC Bench on Tuesday ordered to take away charge from Jani.” Joshipura was not available for comments.

The SU Syndicate had,in a special meeting on January 7, rejected Governor and university Chancellor Dr Kamla Beniwal’s direction to remove Jani after a search committee set up by her found him unqualified for the post. Later,Kambaliya moved the HC with a petition to immediately suspend Jani.

Eight members,(BJP supporters) voted against the Chancellor’s direction,while three (Congress supporters) voted in favour. Jani’s dismissal order was rejected by a majority of five votes.

Syndicate members led by Nidat Barot had maintained that when the Governor had interpreted that Jani’s services should be terminated,the Syndicate had no role to play,but comply with the directions.

On the basis of a complaint by the Congress,the Governor had appointed a three-member search committee to inquire into allegations over Jani’s qualification. Based on the search committee’s report,the Governor had given directions to terminate Jani with a six month’s notice period.

Jani was recruited on May 3,2007. The Congress leaders maintained that the double masters degree and an experience certificate produced by Jani were doubtful. According to the qualification documents produced by Jani,he did his LLB from a Porbandar college during 1999-2003. During 1999-2001,he also did a Masters in Social Work for which he produced a certificate. Besides,he he had also produced a five-year experience certificate from 1999-2000 as Chief Executive Officer with Gitanjali College,which is owned by his brother.

The Congress leaders maintained that LLB is a full-time course and the to-and-fro distance between Rajkot and Porbandar is 500 km. The objections were how Jani manage to do a full-time course at Porbandar along with a master program at SU,while executing responsibilities as CEO at a college in Rajkot — all at the same time.

The Governor had appointed a search committee against V-C Joshipura for not complying with her orders,and for his role in the appointment of Jani. The inquiry is on.
